Eligibility Criteria
You Are in Canada
Refugee claims must be made from inside Canada or at a port of entry (including a land border, airport or marine port).
You have reason to believe that your life or freedom will be threatened.
You must demonstrate that you cannot return to your home country due to a well-founded fear of persecution based on:
Race
Religion
Nationality
Political opinion
Specific social group to which a person belongs (for example gender, sexual orientation or other social identities).
Or, you may run the risk of cruel or unusual treatment or punishment such as threats to your life or risk of torture.
You have no other protection options.
If you can’t find protection in your country of citizenship or residence, then you have to prove that to the government.
Unfortunately, certain individuals are ineligible to make a Refugee Claim.
In Another Country You Have Protection
Provided you have already been recognized as a refugee in another country in which it is safe for you to return back to that country, you are not aged a claim in Canada.
If You Have Previously Made a Refugee Claim in Canada.
If you had previously filed a refugee claim and it was rejected, withdrawn, or simply abadoned, you are not eligible to file another one.
You are Inadmissible on Serious Grounds.
Certain criminal, security, or human rights violations can make you inadmissible for a refugee claim, including:
Serious criminal convictions.
As a danger to the security of Canada.
War crimes or crimes against humanity or both.
You arrived in Canada in accordance to the Canada-US Safe Third Country Agreement (STCA).
For example, the U.S. is considered a safe third country, which means that if you entered Canada from the United States through a designated land port of entry then you are not eligible under the STCA. However, exceptions apply for:
Family members in Canada.
Unaccompanied minors.
Those who have valid travel document of Canada.
