Eligibility Criteria for Pre-Removal Risk Assessment (PRRA) in Canada :
Removal Order
The individual must also be a person that has been ordered to be removed from Canada. This encompasses people who have refused refugee claim and cannot legally stay in Canada any more, those whose visas have expired, those to be deported etc.
Rejection of Refugee Claim
The alleged victim must be a refugee, who has had his or her refugee claim (asylum application) refused by any authority, including the Immigration and Refugee Board (IRB), etc.
No Prior PRRA
The applicant must not have made an earlier application for PRRA on refusal of his or her refugee claim of being issued a removal order (unless the matter has been reached new developments or change of circumstances).
Not Removed Yet
The individual cannot have previously been taken out of Canada at the time he or she applied for the PRRA. PRRA is for those who still reside in Canada, and who face deportation in the near future.
Ancedent – Not a Criminal or Security Threat
The applicant cannot be an inadmissible person to Canada because of criminality, national security concerns, or involvement in activities in violation of international law such as war or crimes against humanity.
Failure to Leave Canada
PRRA is usually provided for a person who has not complied with a removal order to mean that they stay in Canada when the order is made or does not depart Canada willingly.
Timeliness
The PRRA application should be made within a stipulated period after having been given the removal order or having refused the refugee claim. There could be certain conditions within each of these categories that limits application time for PRRA.
Additional Notes:
Protected Persons:
Others, who have been able to apply for and received protection in Canada or who have been determined to be protected persons cannot apply for PRRA since they are already protected by the Canadian system.
Public Safety or Risk to National Security:
Those considered to pose a danger to the lives or properties of other Canadians or Canada’s national security will not be considered for the PRRA.
