An appeal is only available if your application has been rejected or turned down. However if partners, children, relatives or friends you sponsored, or any other persons sought residency, the outcome could be a different story

Legal Grounds for Appeal
You need to be able to show legal justification why you are challenging the refusal. This could include: Omission and commission of mistakes by the immigration authorities. Relating the facts or evidences in wrong way. Others believe that it is due to wrong implementation of legal provisions or standards regarding immigration. Some of the vital information or documents, are not included during the preparation of reports.

Compliance with the Submission Time Line
They have to be made within the stipulated time as specified by law and normally between three to nine months from the notice of refusal. Failure to meet this deadline normally implies that the appeal will be rejected.

The appeal has to be filed in the proper immigration tribunal or the appeal body in accordance with the Laws in your country (IAD, IRB etc.).

New Finding or Information that was not Earlier Presented
Although not always possible, bringing new or other evidence which was not presented at the time of the initial decision will help your case. This may consist of new documents, new information or, correction of previous misconceptions that anybody came across.

Notes for Review When There has been no Previous Appeal or Decision
If your case has already been tried and judgment has been given and particularly if the case was heard and determined at the appeal process or any other process the second chance of appealing depends with certain grounds or discovery of new circumstances that had not previously come to the notice of the court.

No Pending Legal Review
The decision cannot be under the justice or legal control or can be legally challenged. This is especially the case if you are pursuing an appeal to the decision through some other legal proceeding like a judicial review then you may not be in a position to file an appeal unless the latter process is complete.

Grounds for Remedial Action
The appeal should be able to convince that initial refusal or denial was unfair, and that there is a basis for correcting this in this case. This can include providing evidences to confirm that the decision was made based of wrong information, wrong process or overlook consideration.

No Other Available Recourse
At times, an applicant may have no option than to seek other legal remedies (for instance, appeal for reconsideration, appeal again). There may be a legal remedy that you have to try first before referring to this rule, though.

Standing to Appeal
They include the following; The applicant or their representative must be able to bring the appeal concerning the matter. This means that the appellant has to be the person aggrieved by the decision for party, for example, the sponsored individual or the sponsor, or a legal representative of the party.
